$12.7 million verdict in Federal Court

Attorneys John H. Brazilian and Alec S. Pine obtained a $12.7 million verdict in Federal Court in a construction dispute after a two-week trial conducted entirely by Zoom before Chief Judge, F. Dennis Saylor IV, in the United States District Court for the District of Massachusetts.

The award will also include costs and expenses, including reasonable attorneys’ fees associated with the action.

The case involved a dispute between an owner and contractor over the construction of two self-storage facilities—one in Malden, Massachusetts, and the other in New Rochelle, New York. Attorneys Brazilian and Pine represented the project owner and proved that the contractor was liable for breach of contract, fraud, conversion, and tortious interference. The Court’s analysis of the evidence is detailed at-length in a 72-page memorandum filed on September 10, 2021. The verdict is currently the second largest in Massachusetts this year.
