Alec S. Pine Secures $1.85 Million Settlement for Client with Severe Leg Injury from Pit Bull

We are proud to announce that Butters Brazilian Partner Alec S. Pine has secured a $1.85 million dollar settlement for our client in what is believed to be the largest reported personal injury settlement for a single plaintiff in a dog-related injury case in Massachusetts.

In September 2022, our client, then 70 years-old, was enjoying a pleasant morning at a public park in Boston where she was talking with friends. At the same time, a dog owner entered the park and allowed his large pit bull to go off leash. The pit bull began chasing another dog around the park and the pair ran directly toward our client, whose back was turned. Without any warning from the owner, the pit bull charged full speed into our client’s knee, sending her flying three feet into the air before crashing down onto the concrete. Onlookers reported that the client’s injuries were gruesome and immediately apparent. Ultimately, our client suffered comminuted fractures of multiple bones in her leg requiring several surgeries, extensive medical treatment, rehabilitation and therapy. Her active lifestyle was abruptly halted because of limited functional mobility to her injured leg which also forced her to obtain alternative housing accommodations.

Attorney Pine was determined to hold the dog owner accountable for the incident under M.G.L. Chapter 140, Section 155, which is commonly referred to as the “strict liability dog statute.” The statute is unforgiving and imposes strict liability on the owner or keeper of any dog which causes harm to a person with limited exceptions that did not apply to the matter at hand. After thorough investigation, which included meticulously corroborating the numerous ways in which our client’s quality of life and wellbeing were negatively impacted from her injury, the parties agreed to resolve the matter.

We extend our deepest gratitude to our client for her courage and resilience. It is our hope that cases like this serve as a warning to dog owners about the critical importance of proper restraint and supervision for canines–even a good dog can have a bad day.
